Please read this disclaimer carefully before using TowBuddy's services. By using our platform, you acknowledge and agree to all terms outlined below.

Platform Service Nature

TowBuddy is exclusively a technology platform that connects customers seeking towing services with independent towing companies. We do not provide towing services directly.

Our role is limited to facilitating introductions between customers and towing service providers through our digital marketplace. TowBuddy does not operate tow trucks, employ drivers, or provide any towing services whatsoever.

All towing services are performed by independent third-party contractors who operate their own businesses, maintain their own insurance, and are solely responsible for their services, equipment, and actions.

Limitation of Liability

TowBuddy expressly disclaims all liability for any damages, losses, injuries, or harm that may occur during or as a result of towing services, including but not limited to:

  • Property damage to vehicles, personal property, or real estate
  • Personal injury or death
  • Theft, vandalism, or loss of personal property
  • Mechanical damage caused during towing operations
  • Delays in service or failure to provide service
  • Financial losses or consequential damages
  • Actions or omissions of towing service providers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOWBUDDY'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY THE USER FOR THE SPECIFIC SERVICE IN QUESTION.

Independent Contractor Relationship

All towing companies using TowBuddy's platform are independent contractors and are not employees, agents, or representatives of TowBuddy. Each towing company:

  • Operates under their own business license and authority
  • Maintains their own commercial insurance and bonding
  • Sets their own rates and service terms (subject to platform guidelines)
  • Is solely responsible for their equipment, vehicles, and personnel
  • Makes independent decisions regarding service acceptance and delivery

TowBuddy does not supervise, control, or direct the manner in which towing services are performed.

User Responsibilities and Assumption of Risk

By using TowBuddy's platform, users acknowledge and agree that:

  • They assume all risks associated with towing services
  • They are responsible for verifying the credentials and insurance of service providers
  • They should inspect their vehicle before and after service
  • They are responsible for removing valuable items from their vehicle before service
  • They understand that towing operations carry inherent risks
  • They agree to hold TowBuddy harmless from any disputes with service providers

Disclaimers and No Warranties

TowBuddy provides its platform "AS IS" and "AS AVAILABLE"without warranties of any kind, either express or implied, including but not limited to:

  • Quality, safety, or reliability of towing services
  • Availability of service providers in your area
  • Response times or service completion
  • Accuracy of information provided by service providers
  • Fitness for a particular purpose
  • Non-infringement of third-party rights

We do not warrant that our platform will be uninterrupted, error-free, or free from viruses or other harmful components.

Indemnification

Users agree to indemnify, defend, and hold harmless TowBuddy, its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

  • Use of towing services obtained through our platform
  • Interactions with towing service providers
  • Violation of these terms or applicable laws
  • Negligence or misconduct of the user
  • Any disputes between users and service providers

Insurance Advisory

IMPORTANT: Users are strongly advised to verify that any towing service provider has appropriate commercial insurance, licensing, and bonding before engaging their services.

TowBuddy does not provide insurance coverage for towing services and is not responsible for verifying the insurance status of service providers.

Users should also check with their own auto insurance carrier regarding coverage for towing services.

Governing Law and Dispute Resolution

This disclaimer and all disputes arising from or relating to the use of TowBuddy's platform shall be governed by the laws of the jurisdiction where TowBuddy is incorporated, without regard to conflict of law principles.

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, and users waive any right to participate in class action lawsuits.
